Abstract
In the modern digital, or information society, legal rules are undergoing the most dynamic changes, redefinition and adaptation, creating a very challenging environment for practicing law, either at the level of doctrine or at the level of creating legal rules. The work that the authors submit for the conference is scientific response to the modern challenges posed to law and lawyers, in the narrow field of property law with the emergence of a new institute - digital property. Digital property is seen as a consequence of the impact of digital technology on property law, which will be analyzed from a phenomenological aspect in the first part of the paper. The second segment of the paper will present two legal instruments for the regulation of digital property, one at national level and the other at supranational level, as practical examples of modern trends in the development of law under the influence of digital technology. Bearing in mind that the law cannot regulate what it cannot classify, the third part of the paper will analyze different approaches to the regulation of digital property, both at the national and supranational levels, which will indicate the potential classifications of digital property within legal system, which the authors will specifically and critically refer to in the final part of the paper.
